Dynamic Muscle and Fitness Membership Form

Members Eligibility, Terms and Conditions.

1.1. Members must be at least 18 years of age. Individuals aged 16–17 may join with written parental or guardian consent and must be supervised by an adult member during all visits unless otherwise agreed.

1.2. All members must complete a membership application form and provide accurate personal information, including contact details and any relevant health information.

1.3. The Gym reserves the right to refuse or terminate membership at its discretion, including for non-compliance with these Terms or behavior deemed unsafe or disruptive.

2. Membership Types and Fees

2.1. Membership fees, and payment schedules are outlined in the membership agreement provided by Ezypay at the time of sign-up. A Sign up fee (separate from agree’d scheduled membership payments) is payable at the gym at the time of joining.

2.2. All fees must be paid in advance via the payment method specified in the membership agreement (e.g., direct debit, credit card).

2.3. Membership fees are non-refundable except as outlined in Section 7 (Termination and Cancellation).

2.4. The Gym reserves the right to adjust membership fees with at least 30 days’ written notice to members. 

2.5. A one-time joining fee and/or access card fee may apply, as specified at sign-up.

3. Access to Facilities

3.1. The Gym operates 24/7. Members are granted access via a personal access card or digital key, which is non-transferable.

3.2. Members must enter their digital key upon entry. Failure to do so may result in denied access.

3.3. Lost digital key (pin code) - Contact management for members pin access.

3.4. Sharing access pins or allowing non-members to enter the facility is strictly prohibited and may result in membership termination and/or a $50 dishonor fee will be charged to the member responsible.

3.5. The Gym may temporarily close or restrict access for maintenance, repairs, or events. Members will be notified in advance when possible, and no refunds or extensions will be provided for such closures unless they exceed 7 consecutive days.

4. Health and Safety

4.1. Members must complete a Pre-Exercise Questionnaire or provide a medical clearance if requested, disclosing any health conditions that may affect their ability to exercise safely.

4.2. Members are responsible for ensuring they are physically capable of using the Gym’s equipment and facilities. Consult a medical professional if unsure.

4.3. Proper athletic attire, including closed-toe shoes, must be worn at all times. No sandals, bare feet, or inappropriate clothing are permitted.

4.4. Members must wipe down equipment after use with provided cleaning supplies and return all equipment to its proper place.

4.5. Food, glass containers, and alcohol are prohibited in the workout areas. Water and or supplements in a sealed container is permitted.

4.6. Smoking, vaping, or the use of illegal substances is strictly prohibited on Gym premises.

4.7. Members must follow all posted safety guidelines and instructions from Gym staff. Failure to comply may result in immediate removal and/or membership termination.

5. Code of Conduct

5.1. Members must treat all staff, other members, and Gym property with respect. Harassment, bullying, or discriminatory behavior will not be tolerated.

5.2. Loud or disruptive behavior, including excessive noise or inappropriate language, is prohibited.

5.3. Photography or videography is permitted only with the consent of all individuals being recorded and must not disrupt others.

5.4. Personal belongings must be stored in designated lockers. The Gym is not responsible for lost or stolen items.

5.5. Members must report any accidents, injuries, or equipment damage to staff immediately.

6. Personal Training, Classes and health professional services.

6.1. Personal training and group fitness classes may be offered for an additional fee, subject to availability and separate terms.

6.2. Only Gym-approved trainers/health professionals are permitted to provide personal training and other fitness/health services on the premises and fee’s will be incurred for Third party business conducted on the premise.

6.3. Class bookings must be made in advance.

7. Termination and Cancellation

7.1. **By the Member**:

   - Members may cancel their membership by providing written notice via email, text message or in person at the Gym.

   - No refunds will be issued for prepaid memberships unless required by law.

   - A cancellation fee may apply, as outlined in the membership agreement.

   - Cancellation due to medical reasons requires a doctor’s note, and the Gym may waive fees or provide a membership freeze at its discretion.

7.2. **By the Gym**:

   - The Gym may terminate a membership immediately for violation of these Terms, non-payment of fees, or behavior deemed unsafe or disruptive.

   - Terminated members will not receive refunds and may be barred from future membership.

7.3. Memberships are automatically terminated upon the member’s death, with no further fees charged.

8 Membership freeze for special reasons

8.1. Members may request a temporary freeze of their membership for a minimum of 1 month for a one-off travel event or for medical reasons. Freezes for medical or travel reasons may be granted without a fee, subject to documentation (e.g., medical certificate). Request must be made via a message prior to travel and at time of the medical reason. No back dating of membership freeze prior to a request will be granted.

9. Gym Machines and Equipment

9.1. Only registered gym members with active memberships may use the equipment.

9.2. Members must complete a safety induction or orientation before using any machine independently.

9.3. Guests or trial users must be supervised by staff or a certified trainer.

9.4. Wipe down equipment after use with provided sanitizing wipes or spray.

Usage Guidelines

9.5. Follow posted instructions for each machine and adhere to staff guidance.

9.6. Do not modify machine settings or remove safety pins, clips, or guards.

9.7. Limit use of cardio machines to 30 minutes during peak hours.

9.8. Return all free weights, bars, and accessories to their designated racks after use.

9.9. Avoid dropping weights or using equipment in a way that causes excessive noise or vibration.

9.10. Misuse of equipment or unsafe behavior may result in suspension or termination of membership.

9.11. Gym staff reserve the right to stop any activity deemed unsafe or inappropriate.

9.12. Members must comply with all staff and machine instructions regarding equipment use and safety procedures.

9.13. Repeated violations may lead to disciplinary action, including membership cancellation.


10. Liability and Assumption of Risk

10.1. Members use the Gym’s facilities and equipment at their own risk. The Gym is not liable for injuries, damages, or losses sustained during use, except where caused by the Gym’s gross negligence.

10.2. Members are responsible for any damage to Gym property caused by their negligence or misuse and may be charged for repairs or replacements.

10.3. The Gym is not responsible for lost, stolen, or damaged personal property.


11. Privacy

11.1. The Gym collects, stores, and uses personal information in accordance with its Privacy Policy, available on the Gym’s website or upon request.

11.2. Members consent to the use of security cameras for safety and monitoring purposes.

12. Changes to Terms and Conditions

12.1. The Gym reserves the right to amend these Terms at any time. Members will be notified of changes via email or posted notices at the Gym at least 30 days in advance.

12.2. Continued use of the Gym after changes take effect constitutes acceptance of the revised Terms.
